By accessing and using Marefiya ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Marefiya is a platform that connects individuals seeking mental health support ("Clients") with certified mental health professionals ("Professionals"), including psychologists, psychiatrists, and counselors. The Platform facilitates appointment booking, communication, and access to mental health resources.

3. User Accounts

3.1 Account Creation: To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3 Professional Verification: Professionals must provide valid credentials and licenses. Marefiya reserves the right to verify professional credentials and may suspend or terminate accounts with invalid credentials.

4. User Responsibilities

4.1 Clients: You agree to use the Platform in good faith, provide accurate information, and respect the time and expertise of Professionals.

4.2 Professionals: You agree to maintain valid professional licenses, provide accurate information about your qualifications, maintain professional standards, and comply with all applicable laws and regulations.

4.3 Prohibited Activities: You agree not to:

Use the Platform for any illegal or unauthorized purpose
Impersonate any person or entity
Interfere with or disrupt the Platform or servers
Attempt to gain unauthorized access to any portion of the Platform
Harass, abuse, or harm other users
Share false or misleading information

5. Appointments and Services

5.1 Booking: Clients may book appointments with Professionals through the Platform. All appointments are subject to Professional availability and confirmation.

5.2 Cancellation: Cancellation policies are set by individual Professionals. Clients are responsible for reviewing and adhering to these policies.

5.3 No Medical Emergency Service: Marefiya is not an emergency service. In case of a medical emergency, please contact your local emergency services immediately.

5.4 Professional-Client Relationship: The Platform facilitates connections but does not create a professional-client relationship. The relationship is between the Client and Professional directly.

6. Fees and Payments

6.1 Service Fees: Professionals set their own fees for services. Marefiya may charge platform fees as disclosed at the time of booking.

6.2 Payment Processing: Payments are processed through secure third-party payment processors. You agree to provide valid payment information.

6.3 Refunds: Refund policies are determined by individual Professionals and Marefiya's refund policy, as applicable.

7. Privacy and Confidentiality

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Platform, to understand our practices regarding the collection and use of your information.

Professionals are bound by professional confidentiality obligations and applicable laws regarding patient privacy.

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by Marefiya and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Disclaimers

9.1 Platform as Intermediary: Marefiya is a platform that connects Clients and Professionals. We do not provide medical, psychological, or therapeutic services.

9.2 No Warranty: The Platform is provided "as is" without warranties of any kind, either express or implied.

9.3 Professional Services: Marefiya does not endorse or guarantee the quality, accuracy, or effectiveness of services provided by Professionals.

10. Limitation of Liability

To the maximum extent permitted by law, Marefiya shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

11. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach the Terms of Service. Upon termination, your right to use the Platform will immediately cease.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Material changes take effect upon posting, and we will provide notice through the Platform or by other reasonable means. What constitutes a material change will be determined at our sole discretion.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Marefiya operates, without regard to its conflict of law provisions.
